What kind of charges am I looking at and what kind of time?

default-avatar
Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
Criminal Law lawyer at Freeborn Law Offices P.S.
You have serious problems. Some of the charges you can face are trespass, burglary, breaking and entering, theft, malicious mischief. You are also, I am sure, in violation of your terms of probation, which means that the judge could order your to serve jail time for the probation violation... This is separate and apart from what will happen with the new charges.

How do we get this person out of the home for elderly abuse?

default-avatar
Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Criminal Law lawyer at Andrew T. Velonis, P.C.
I have two answers, and you might want to do both: 1) See if your local county Department of Social Services has an elder abuse division. If so, contact them and explain the situation. Work with them to get the help your parents need. 2) You, or some other trusted person can become the guardian for one or both of your parents. That person should be able to get a temporary order pending the appointment, and once appointed, the guardian has full authority.

What can I expect at a docket call after an arrest for theft by check?

default-avatar
Answered by attorney Andrea Rogers (Unclaimed Profile)
Criminal Law lawyer at The Rogers Law Firm
At the docket call, you will be asked if you are pleading guilty or not guilty. If you plead guilty, you will be convicted and you will have to pay restitution (pay back the amount you stole). If this is a misdemeanor charge (less than $500), the potential sentence is up to 1 year in jail plus a fine of up to $1,000. That conviction will stay on your record permanently. If you plead not guilty, the judge will set your case for trial. You will need to hire an attorney to represent you to keep this off your record. If you can't afford to hire a private attorney, then ask the judge to appoint a public defender.
