Yes, initially you should plead "NOT Guilty". If you plead guilty to the charge you will have a criminal conviction on your record for the rest of your life. Usually, especially for first time offenders, the DA (prosecutor) will offer the Defendant (you) the opportunity to plead guilty to a reduced charge which will not give you a criminal record. If you cannot afford a lawyer the court should appoint a lawyer to represent you, either Legal Aid or 18B. It depends where in NYS you are located and what court your case is in. Definitely speak to a criminal defense attorney about this case before you just plead guilty. Good luck!
