Can I get someone arrested for stealing something in my house?

Answered by attorney Seth David Schraier
Criminal Law lawyer at Law Office of Seth D. Schraier, P.C.
Yes. If someone takes something of yours without your permission then this is larceny. If you believe that this has occurred, you should call the police. Make sure that you have all the details necessary for the police, such as their relation to you, how long they stayed in the house, what was taken, when you noticed it was taken, and what proof you have that it could have only been this person who stole it from you.

Can I be charged with a felony if the theft victims do not press charges?

In Oregon, the local District Attorney is the prosecutor. If you have been charged with a crime, than someone reported it and the prosecutor is pressing for a conviction. Giving back the money that you stole could be a very helpful approach for taking responsibility and minimizing your exposure to jail or prison. You need to hire an attorney. You are way over your head. Please call.

Does having a paid for attorney benefits me more than having a court appointed one?

A paid attorney is always better. They are more responsive to your questions, and because you pay them, you never have to worry where their loyalties lie.
