If no restitution was ordered in criminal court, they property owners can sue in small claims court. She plead guilty, there is no issue of liability, just damages.

The reason the prosecutor won't drop the charges is because crimes are against society, not just you. If he will do this to you, he might do this to other people. You can drop the charges but the prosecutor has every right to go ahead with the prosecution.
