I'm not sure what your question is.  If you in any way assisted your sister in the theft or attempt to steal the property, then you can be charged with petit larceny.  In addition, an individual can be charged with petit larceny without actually leaving the store.

If someone starts a fire and someone dies, the person starting the fire can be arrested. Whether the jury returns a guilty verdict (criminal liability) or buys the accident defense is totally up to the skill of the trial attorney.
