About Lee Livingston

Lee has a 29-year history of success helping people who have been seriously injured. This has resulted in peer review awards including being selected as “Lawyer of the Year" for both personal injury law and medical malpractice law by U.S. News and World Report, Best Lawyers.

Lee frequently is brought into complex cases by outside lawyers. His list of top verdicts and settlements is long. He was part of likely the largest settlement involving a drunk driver in Virginia, the top verdict against the largest orthopedic practice in Virginia in 2018, and the top settlement involving county employees in a wrongful death case in Fairfax in 2019 (overcoming complex sovereign immunity issues).

Lee consistently achieves seven-figure verdicts, getting full justice for deserving people. For example, in 2015 he won the first verdict by a patient against a doctor in Augusta County, VA, followed in 2016 by what is believed to be the best verdict in an elective plastic surgery case in Richmond, Virginia.

Lee’s record of leadership highlights the priority he places on exceptional advocacy. He served as president of the Virginia Trial Lawyers Association, as one of two State Bar Council representatives from the seven counties in the 16th Judicial District for two terms, and chaired the Virginia State Bar litigation section and the mandatory continuing legal education board.

Lee was selected by the Chief Justice of the Supreme Court of Virginia to work on a committee that writes and edits jury instructions for Virginia trials.

Winner of the annual Lighthouse Award from the Southern Trial Lawyers Association in 2019, an award given to one lawyer per year in the United States for pioneering work in trial advocacy and mentoring, Lee edits books for lawyers about evidence and medical malpractice that are published by LexisNexis.

Great trial lawyers are both born and made. Lee was lucky to be trained and mentored by deans of the Virginia bar: Tom Albro, a pioneer in Virginia medical malpractice law who successfully changed the law to allow UVA and other state hospital doctors to be held accountable for malpractice without the protection of the doctrine of sovereign immunity (based on the ancient concept that "the King can do no wrong"); Lee began his career by clerking in Federal court in Charlottesville for Hon. Judge B. Waugh Crigler (B. Wise, B. Witty, B. Waugh), who is now one of the top mediators in Virginia and is loved and respected by all.

Lee enjoys hiking in the Blue Ridge Mountains and travel in his spare time.

Thank you, Lee, for a job well done! You took my case when others doubted my situation. From start to end, you constantly and consistently maintained a high level of professionalism, and were always reassuring when I became worried, impatient, or sometimes, just discouraged. The work you did behind the scenes was simply amazing. A true testament to your work ethic, diligence, and ability to acquire information that was invaluable towards resolution. Thank you for your kindness, patience, encouragement, and above all, the hope you kept alive throughout the process. I could not have wished for better representation. Thank you again. You were the best advocate for me.

Lee Livingston is a scholar, a gentleman, and a phenomenal attorney. I am privileged to know him, forever grateful that he took my case. The case was complex, and I was a traumatized witness who faltered throughout the process, scared and angry.. Lee’s skill and clarity brought me back from the brink many times, before, during and after the trial through a protracted appeal process. I was a wreck. Thanks to Lee and his superior team, we made it through to justice and a verdict in my favor.

Lee gave me a discount on his feet because the settlement took so long. Lovely man and great lawyer.

Unbelievably disappointed. Took on my 80 year old mothers case and then dropped the bomb with nothing in the end. She was overdosed on medications so severely and her life will never be the same. Now this attorney failed our family in representing and establishing their error. No wonder pharmaceutical companies make errors and get away with them every day. Huge disappointment!

Lee Livingston is a very rude and condescending man who sat on my case for 6 months doing nothing and tried to charge me over $775 after he dropped my case getting nothing done

Response from Lee Livingston
Whoever posted this has not complained to me. I am lucky to have represented victims of legal malpractice and made substantial recoveries in meritorious cases. I welcome a call from the reviewer in the event there was a misunderstanding.
