You should talk to your bankruptcy lawyer. If your landlord is attempting to collect a debt that was incurred prior to your bankruptcy filing and which was included in your bankruptcy, he/she may be in violation of the bankruptcy stay by attempting to collect this debt.

The facts you have presented are a little skewed so I can't tell what happened. I assume you filed for Chapter 7 bankruptcy. There is no such thing as "not included in bankruptcy", EVERYTHING must be included and I am sure was included in the bankruptcy. There is also no such thing as "reaffirmation of a home mortgage" in the central district of California, the judges will absolutely not do it. What I would like to know (and whatever lawyer you go with should know) is 1. were you current on your mortgage with US Bank/Select? What does the notice of default say? And, was the foreclosure reported on your credit report? Those are key pieces of information in any lawsuit.

As long as you continue to pay the mortgage on the house, the mortgage company cannot take your house away. I would suggest that you check your credit report & FICO score 3 or 4 times a year for the next two years. It is very likely that the mortgage company will report on your credit that the debt is in bankruptcy, which is true. Should the mortgage company report by mistake that you are in bankruptcy, you should immediately dispute this claim. By checking your credit score with FICO (the only company that creditors use when making a decision whether to lend to you), you can see if any misinformation has harmed you and get to work to correct it.
