You do not have to be behind on payments to get bankruptcy relief. Married persons may file individually.

Is filing Chapter 7 a good option for my situation rather than filing Chapter 13? Or are there better options?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
There is no way to answer your question without getting a lot more facts and having a consultation. There are multiple factors that go into determining (A) whether you're eligible to file in a given chapter and (B) whether that Chapter is the best one for you to file. The equity in your house and the available exemptions will, in part, determine whether your house would be at risk in a Chapter 7.  It would never be at risk in a Chapter 13, but you might have to pay out more to your creditors due to its value. An analysis of your budget will also help determine which chapter would be better for you. In short, you need to have a consultation with a qualified bankruptcy attorney who can get all the relevant facts and advise you on your options. I offer free initial consultations, which you can schedule from my webpage should you be interested. I would be happy to help.

If you reaffirmed the debt, you will be liable for any deficiency (that amount due after the vehicle is sold). If you did not reaffirm the debt, and you received your discharge, and the liability was properly listed in your schedules, then you have no liability for the deficiency.
