What should I do if I can't afford a bankruptcy attorney?

Peter Brian Mullison
Answered by attorney Peter Brian Mullison (Unclaimed Profile)
Bankruptcy lawyer at Colorado Bankruptcy Law Group, LLC
This is a common question. You do not need to hire an attorney to file bankruptcy. But you should be prepared to educate yourself on bankruptcy law to make sure that you don't make any mistakes that could result in your case being dismissed or losing any of your assets. Some common ways to pay for an attorney include borrowing money from a close friend or family member, using your tax refund, or saving for a few months to collect the fee. You also need to consider the court filing fee, which at this time is $306. You may qualify for a waiver if your income is less than $150 of the current poverty level. You can also pay the filing fee in up to four monthly payments beginning the month after you file.

How do I withdraw a bankruptcy petition that has a case number?

If you have filed for bankruptcy and the case is still active, you need to file a motion to dismiss the bankruptcy. However, this can be difficult to do, particularly if you filed for a chapter 7 bankruptcy. You should probably consult a bankruptcy attorney to see if it is possible to dismiss your bankruptcy case.

If I do file Chapter 7, will this remove the debt from my ex-husband as well?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
There are several questions here. A Chapter 7 stays on your credit report for 10 years-but there are ways to improve your credit score soon after the bankruptcy so that the weight of the bankruptcy is less and less. You may or may not be able to discharge the debt if it was assigned to you in the divorce. In any case, your chapter 7 will not release your ex-husband from the obligation. You might want to find a lawyer who can help you file a Ch. 7 within the next three weeks. My office could do that without much difficulty.
