Can I file for bankruptcy after our divorce? How?

Answered by attorney John F Brennan (Unclaimed Profile)
Bankruptcy lawyer at Musilli Brennan Associates, PLLC
I would have to see the details, but generally you are not allowed to file another bankruptcy in so short a time from your previous bankruptcy. I would suggest you consult with the bankruptcy and family law attorney to determine what is and is not dischargeable.

If you are on title and file bankruptcy there will be an automatic stay. However, the lender will file a motion for relief from stay and get permission to foreclose.

Answered by attorney Joon Mo Khang (Unclaimed Profile)
Bankruptcy lawyer at Khang & Khang LLP
You can file once every 8 years and count the 8 years from the date that you last filed. So if you filed December 01, 2005 you can file again any time after December 01, 2013.
