Can I file bankruptcy even if there is a law suit filed against me? And if yes, what kind of bankruptcy?

Jeffrey Alan Cogan
Answered by attorney Jeffrey Alan Cogan (Unclaimed Profile)
Bankruptcy lawyer at Jeffrey A. Cogan Chartered, a PLLC
Yes, you can file for bankruptcy as that is one of the primary purposes. If you make more than $75,000 a year, you will probably be in a Chapter 13. If you make less than that, then chapter 7, where you are done in about 4 months and you don't have to pay anyone back.

If I lent a friend thousands of dollars with promise of repayment and they just entered bankruptcy, can I sue?

Answered by attorney Christopher J. Kane
Bankruptcy lawyer at Christopher J. Kane, P.C.
No, if your friend files bankruptcy you are forbidden from pursuing her for whatever you think she owes you. The only way you can fight the bankruptcy discharge is if you can prove she obtained money from you under false pretenses, by a false representation, or fraudulently. That is a very hard thing to do and, if you think any of those circumstances were present, you should speak to an experienced attorney.
