HOA dues are nondischargeable. If you want to surrender the townhouse then the HOA must satisfy the pre bk filing amount due through the sale of the townhouse. The post filing amounts coming due will still be your responsibility until the townhouse is sold.

I can't see anything else but either: arrange payment plan, ignore and see what happens - maybe they won't sue to collect, sue Mom to recover, or file bankruptcy if the relief is available to you. I can't say whether you can or should file for bankruptcy without understanding more details about your financial situation.

The debtor that filed bankruptcy cannot pick and choose which debt he will pay back. You could put a reaffirmation agreement together where he reaffirms the debt. However, the bankruptcy judge would have to approve the agreement.
