What will happen if I filed bankruptcy and before it was discharged I got a car I really needed and I can no longer afford the car?

Any debt incurred after the bankruptcy FILING date, that is the date you filed the case, is not part of the bankruptcy. This debt would not be reaffirmed because it was acquired after the filing date and therefore not part of the bankruptcy. You remain responsible for the loan. If you turn the vehicle in and after sale there is not enough money to pay off the loan in full and to pay for the costs of liquidation, you can be pursued for the remaining balance.

How long does it take for the attorney to prepare the case?

That time frame does seem to be extraordinary. Have you called to make sure the attorney is not waiting on additional information from you. At this point the attorney will need updated pay stubs and bank statements at the least.

Can I self file and represent myself in the chapter 13 conversion?

Giovanni Orantes
Answered by attorney Giovanni Orantes (Unclaimed Profile)

You may always represent yourself in bankruptcy cases; however, it is not recommended at all as it is not a simple proposition. The failure rate for Chapter 13 cases in which the debtors represent themselves is close to 100%. Indeed, even attorneys without enough experience handling Chapter 13 cases usually cannot get the Chapter 13 plans confirmed because there are many requisites that must be met.
