Can or should I seek legal help to clear up debts that should in theory be falling away from my credit report and dropped by collectors?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
Judgments in Jersey are valid/enforceable for 20 years. Debts can be sued upon for 7 years from the date of the last payment. You may qualify for 7 or maybe you should look at chapter 13.

Can I finance a new car while in chapter 7 bankruptcy but before my meeting of creditors?

Sure, but consult your attorney. You might need approval from your chapter 7 trustee, if you are putting anything down or trading another car in on the new one.

I got into an accident with no insurance and I am being sued for damages can I file bankruptcy?

I would be reluctant to advise bankruptcy based on just one or a few debts. Depending on the amount of damages due to the accident & whether the accident also involved a crime, such as drunk driving, there may be reasons why bankruptcy would not help. On the other hand, bankruptcy might help a lot. You will want to meet with an experienced bankruptcy attorney to assess the entire situation, as there is no simple answer to your question.
