If I lent a friend thousands of dollars with promise of repayment and they just entered bankruptcy, can I sue?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
You can file a proof of claim in the bankruptcy. You cannot sue her outside bankruptcy, but you could talk to a good bankruptcy attorney about filing a non-discharge ability complaint. It is very rare to win on these actions, but it does not hurt to investigate your rights. Make sure the bankruptcy attorney is a very experienced creditor attorney.

Will I still have a judgment after bankruptcy?

Sally J Elkington
Answered by attorney Sally J Elkington (Unclaimed Profile)
Bankruptcy lawyer at Elkington Law
The amount of the Judgment should be discharged in your bankruptcy. As long as the judgment is not a lien, you should not have to do anything further, but file a bankruptcy.

When can I buy a car for a relative that has gone through bankruptcy?

I would wait until she receives her discharge. That way, if her case gets dismissed for some reason and she has to refile, she wont yet own that asset.
