How do I start a llc business with a judgement lien against me?

Shawn Regis Jackson
Answered by attorney Shawn Regis Jackson (Unclaimed Profile)
Bankruptcy lawyer at The Jackson Law Firm, P.C.
Well, the first question is “how would they know”? The second question is “what is the nature of the lien…and who originated the complaint”? Yes, to answer your questions, there are several ways to operate the LLC with your membership without them knowing immediately about your participation.

Can the mortgage company file a lien or is there a statue of limitations?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
Consult your bankruptcy attorney. A mortgage is normally good against the borrower whether or not recorded. However, recording after the petition is filed may not be legal, and a trustee has the power of a lien creditor, and may take over an unrecorded mortgage. Whether asserting such rights requires affirmative action in the bankruptcy or is beneficial to you needs to be discussed with the bankruptcy attorney.
