Is my IRA exempt in bankruptcy?

Giovanni Orantes
Answered by attorney Giovanni Orantes (Unclaimed Profile)
Bankruptcy lawyer at Orantes Law Firm
IRAs are exempt up to a limit ($1,000,000 the last time I checked), but if somebody placed a lien on an IRA that encroaches on an exemption, it can be removed with a motion in the bankruptcy case.

How will it affect me if my ex-husband is filing for bankruptcy?

It is possible that the lender may, in error, report that you have filed bankruptcy. Disputing this will correct the mistake. But bankruptcy law requires the lender to stop reporting information regarding payments made after bankruptcy and because your loan payments are no longer being reported, this may lower your credit score. You can discuss this issue with the lender but it usually will be a futile result.
