Everything depends on the type of business entity you operate under. Is the business a corporation, LLC, partnership or sole proprietorship? Talk to an experienced business bankruptcy attorney ASAP. The fact that your business property is free and clear is troubling.

The income numbers for the Means Test are based on gross income. However, your assumption that you must meet these numbers to be able to file bankruptcy are incorrect. If your gross income is above the median amount, you only need to have sufficient qualifying deductions to be eligible to file Chapter 7 bankruptcy. Calculating the deductions is quite the tax, so I would urge you to obtain representation from an experienced bankruptcy attorney.
