Unfortunately a creditor or debt collector is generally not under any obligation to negotiate a settlement. The amount of payments if any is up to the agreement of the parties. On the other hand, medical bills are very difficult to collect. They are often filled with errors and overcharges. Send a letter disputing the debt, requesting a detailed itemization of the bills, and request a copy of the medical records, with a copy to each provider. Go through the bills and compare them to the records and see if there are any discrepancies. Chances are there will be some, along with charges for items or services not furnished and outlandish items (e.g., $100 for an aspirin). The provider or collector has to prove that the bills are accurate, the services are medically necessary, and the reasonable value of the services. The collector may become more reasonable when it sees you will not just accept the charges at face value. Also, check and see if you qualify for charity care/ write offs. Illinois hospitals are required to provide same in exchange for their tax exemptions.

Will a discharged chapter 7 bankruptcy protect us from foreclosure?

Yes, the bankruptcy will protect you. A secured creditor is still entitled to get its security back, however. The bankruptcy does not eliminate the lien. It does eliminate your personal liability on the debt. Thus they will only be able to get the property back. If you owe more than the property is worth, that excess has been discharged in bankruptcy. So they cannot garnish your wages, etc. If you do not sign a deed in lieu of foreclosure, the creditor will have to go to the expense of foreclosing on the mortgage to get the property back. If you do sign the deed in lieu, you will save the lender time and money. In either case you will not owe more. One exception for real estate is homeowner's association fees. Since those generally occur on a monthly basis, each month is a new bill. So every bill for condo fees or homeowner's association dues that occurs after you filed your bankruptcy is not covered by your bankruptcy discharge. It is a post petition debt. In most cases the person who gets the property back will end up paying the condo fees to clear up the debt in order to sell the property. The condo association or homeowner's association may not be willing to wait that long. If that happens, they may sue you and your bankruptcy won't stop it.

Chpt. 7 bankruptcies are designed for people who cannot afford to pay anything to their unsecured creditors (credit cards, medical bills, past due rent or utilities, etc.). If you can afford to pay your creditors anything, after paying your normal, reasonable monthly living expenses, then you cannot do a Chpt. 7. Another big consideration with Chpt. 7: If you have any assets that are worth more than you can exempt under your available state or federal exemptions, the Chpt. 7 Trustee will take the asset and sell it to pay creditors. In Chpt. 13, that is very unlikely to happen; however, you will need to make monthly payments to the Chpt. 13 Trustee based on several factors, including how much you can afford to pay your creditors, and whether your assets exceed your available exemptions. There are other factors that need to be taken into account, so all this is more complicated than I can write here.
