Do secured lenders have the ability to pursue individual LLC members in a Chapter 11?

Answered by attorney Eric N. Assouline
Bankruptcy lawyer at Assouline Berlowe, P.A.
The purpose of the lender obtaining a personal guaranty from an individual is to protect the lender from not being paid in full from the primary obligor. As in this case, the LLC cannot satisfy the lender's claim so it can pursue the individual guarantors.

What can I do if the creditors did not show up to the meeting?

Answered by attorney Max L Rosenberg
Bankruptcy lawyer at Rosenberg Hite, LLC
Clearly you do not have an attorney or you would know that 99% of the time creditors do not show up at the creditors meeting. As far as what you should do now, you have no choice but to wait and hope that nothing else happens in your bankruptcy. It is out of your hands. All you must do is comply with the trustee.

How soon after we walk away from a mortgage that was not reaffirmed in Chapter 7 can we qualify for another mortgage?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
There is no answer to this question that will be adequate for you. Getting a home depends upon requirements of the lenders you apply to. The debt has been discharged, you do not owe it. The mortgage will show up on your credit report as being discharged.
