What exactly is Chapter 7 Bankruptcy?

default-avatar
Answered by attorney Todd Allen Whiteley (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Todd Whiteley
Chapter 7 is the liquidation chapter of bankruptcy law. If you "pass" the means test and are eligible for chapter 7 bankruptcy protection, then Chapter 7 will discharge your general unsecured debts - usually credit cards, medical debts, etc. Chapter 7 and all bankruptcy chapters include all your assets (home too) and debts. Where people sometimes get confused is that Chapter 7 allows a debtor to continue making payments and keep his/her house or other secured collateral. Of course, if you are behind on payments or can't make the house payments after discharge, a Chapter 7 will not allow you to stay in the house beyond foreclosure sale.

If you have broken leases and you file for bankruptcy, will those broken leases still show on your history after you file?

Answered by attorney Ronald Karl Nims (Unclaimed Profile)
Bankruptcy lawyer at Ronald K. Nims
Bankruptcy doesn't remove items from your credit report. If the broken lease is reported now, it will continue to be reported. Most landlords don't subscribe to one of the mainstream credit reporting agencies, there are specialized agencies that focus on tenant issues.

Can I represent my mother in small claims court?

default-avatar
Answered by attorney Linda Kaye Frieder (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Linda K. Frieder
The court has to be asked for its permission to allow someone to appear for another party in small claims court. To ask for permission, the person who will appear needs to get and fill in the Authorization to Appear on Behalf of Party (Small Claims) (Form SC-109) (This is not done by the party who is not going to appear in court.) The person who will appear should take the original Form SC-109 and 2 copies to the hearing. On that day, a copy of the request should be given to the other side and the original request should be given to judge at the beginning of the hearing. (See California Code of Civil Procedure, Section 116.543(j).
