How do I find a class action against BofA

default-avatar
Answered by attorney Kenneth Louis Wake (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Kenneth L. Wake, Jr.
I agree.  It's very wrong but I have seen numerous people get lured into the same situation.  Since they haven't actually went through with a foreclosure (which is apparent from their requests that you deed the house to them or short sale it to them), you could file a chapter 13 bankruptcy and catch the house up over the next 5 years.  I also would take a hard look at the equity in the house and seriously consider whether or not it was worth trying to catch up before I put another cent into saving it.   What Texas County do you live in?  This would determine what Court had jurisdiction.   Thanks...Ken Wake

What form do you use when you are filing a chapter 7 if you own a home and want to keep it?

Sean Thomas Flynn
Answered by attorney Sean Thomas Flynn (Unclaimed Profile)
Bankruptcy lawyer at The Law Offices of Sean T. Flynn, PLLC
There are a large number of forms that you have to use. The specific forms that are applicable to your question are that you must file a statement of intention listing that you want to reaffirm your mortgage, and then request and file a reaffirmation agreement with the court. The creditor can typically prepare the agreement for you to sign. Bankruptcy is a complicated legal procedure and I would highly recommend retaining an attorney to make sure that everything is filed correctly.

Can bankruptcy end a civil debt?

default-avatar
Answered by attorney Thomas Anthony Vogele (Unclaimed Profile)
Bankruptcy lawyer at Thomas Vogele & Associates, APC
A debt arising out of a traffic accident can be deemed non-dischargeable through what is called an adversary complaint. Your victim would bring an action, similar to a civil action, but in the bankruptcy court, to make it impossible for you to discharge your debt if the Court decides it is a debt "for willful and malicious injury by the debtor to another entity or to the property of another entity."
