If my ex-wife files for bankruptcy, will I be force to do the same?

John A Moffa
Answered by attorney John A Moffa (Unclaimed Profile)
Bankruptcy lawyer at Moffa & Breuer, PLLC
There is not enough information to properly respond. If you are liable on the Note which is secured by the mortgage, the lender can go after you for the unpaid balance. If you pay the balance as asserted or as negotiated, you don't need to file bankruptcy. If you can't pay the balance, then you should consult someone.

How can I sell my house after discharge in a bankruptcy?

Answered by attorney William Monroe Rubendall (Unclaimed Profile)
Bankruptcy lawyer at William Rubendall Attorney at Law
You can sell your house after your bankruptcy discharge. However, you must re-invest the proceeds in another home within six months. Otherwise, the trustee can sell your house and pay your creditors. Consult an attorney as to the specific facts of your case.

Do you need to provide new address information to your creditors when you move?

default-avatar
Answered by attorney Christopher Emmanuel Benjamin (Unclaimed Profile)
Bankruptcy lawyer at The Barrister Firm, P.A.
No, it's not illegal to move but your lawyer should file notice of your change of address and if your not represented (you really should be though) then it's your responsibility to notify the court, trustee and creditors of your new address.
