We filed chapter 7 and surrendered the home and now the lender is sending deed in lieu papers for us to sign should I sign?

Make sure that you talk to an attorney about the document. It is possible that the deed in lieu has a provision that you will pay a certain amount of debt. Depending on where your property is located it might be better to let them foreclose.

Is there a way I can lump my school loans together with my bankruptcy? How?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
If your question is really whether or not you can discharge your student loans in a bankruptcy, it is extremely difficult to discharge a student loan. You must be so incapacitated that you cannot possibly both support yourself and make even a small monthly payment on the student loans. More readily available are several forbearance and income-dependent programs. Contact your lender for where to go to explore those options.

Could my co-signer sign modification papers in a bankruptcy?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)

A modification is not a reaffirmation and as long as the mortgage company is willing to offer a modification, Mom only needs to be willing to sign the modification agreement. Mom cannot be forced to sign anything unless she wants to.
