How would we know who is responsible for this hospital bill?

default-avatar
Answered by attorney James T Weiner (Unclaimed Profile)
Bankruptcy lawyer at James T. Weiner, P.C.
Whether you are responsible for the bill depends upon several things.. Primarily the terms of the "land trust" If my memory serves Michigan Estates and Protected Individuals Act (EPIC) requires that certain trusts pay over to the estate enough to pay the bills.. to the extent of the value of the assets of the trust. So if the hospital wanted to they could challenge your inheritance through the trust. All of the above said for $740 you can probably ignore it because it will cost much more for anyone to follow that legal thread to collect. and it may cost more than that to even have a lawyer review the information necessary to make a determination of liability.

At which point should I address the car loan in an enforcement of dragnet clause in a Chapter 7?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
There is no such thing as reaffirming a car in a Chapter 13, and there is no way for the credit union to voluntarily undo a cross collateralization. Cross collateralization is part of your membership agreement with the credit union and so obtaining the car loan and the line of credit did not require the CU to repeat all the terms of the agreement you already had with them again. Depending on the age of the car loan, or whether the car loan was to purchase or refinance an existing loan, you might be able to implement a 910 cram-down of the vehicle in your plan.

If someone cosigns a loan and is no longer in contact with the signor and the signor defaults what is the liability to the cosigner?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
This depends on the applicable law. If Illinois law applies and the requirements of 815 ILCS 505/2S are satisfied, the cosigner may have no liability unless he or she was given written notice and a chance to take over payments before any collection action was taken. There are other defenses that may apply as well. Consult a consumer attorney.
