Can my government pensions an Social Security be garnished?

S Christopher Hunter
Answered by attorney S Christopher Hunter (Unclaimed Profile)
Bankruptcy lawyer at Hunter Law Offices, PLLC
The general rule is that social security benefits cannot be garnished directly out of the check or once deposited into a bank account. Qualified pensions cannot be garnished either. However, once a pension is deposited into a bank account it can be garnished. The exception to the general rule is that your Social Security or pension can be garnished if you owe back child support, or money to the state, local or federal governments.

What does he mean when he said that if I make additional payments, it will make filing faster?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
It may mean that he has not filed the Petition or that he is waiting for you to finish paying before he files. The other side is that he filed the case and he has not been paid in full.
