You ought to be able to file Chapter 7 immediately after your chapter 13 is dismissed, but you need to be eligible for chapter 7. If you are not eligible to file Chapter 7, the Chapter 7 will be dismissed as well. I am sure there is a lot more to this story.

Once the lender forecloses that is a reportable credit fact. You can add a 100 word statement to your credit report explaining that the lender was dilatory in doing the foreclosure.

Send the creditor a copy of your bankruptcy notice with case number, they will stop at that point for sure.
