Is retirement money safe in bankruptcy?

Jeffrey David Solomon
Answered by attorney Jeffrey David Solomon (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Jeffrey Solomon
Retirement money" is generally exempt from creditors. You do need to clarify with a consultation with an attorney what you mean by "retirement money". Unless there is a fraudulent transfer issue, you can typically protect an IRA, 401k, and other retirement assets. Mere savings that you want to use in retirement would not be protected in bankruptcy.

What can I do if my bankruptcy case was dismissed?

Bankruptcy lawyer at A Fresh Start
It would certainly help to know why the bankruptcy case was dismissed. In some instances, a dismissal simply means you need to start over again, while in other cases, you would be prevented from filing another bankruptcy for quite some time.

Can my daughter file bankruptcy with her loans?

default-avatar
Answered by attorney Edward M Olson (Unclaimed Profile)
Bankruptcy lawyer at Olson Law Firm
Your daughter may be able to file. Keep in mind that your obligation to pay the loans, in full, will not be affected by her bankruptcy. Also note that student loans are not dischargeable unless you can show "hardship". It is a very hard standard to meet.
