When is it appropriate to start paying a reaffirmed debt, Chapter 7 Bankruptcy?

Answered by attorney William Monroe Rubendall (Unclaimed Profile)
Bankruptcy lawyer at William Rubendall Attorney at Law
If you represent yourself in bankruptcy a reaffirmation agreement must first be approved by the judge before it becomes in effect. However, you can make voluntary payments of the debt before the agreement is approved. Also, if the debt is not approved you still can make voluntary payments as long as the lender will accept them.

What is the process for a Ch 7 Motion to Compel Trustee to abandon interest in a property?

Answered by attorney Thomas Anthony Vogele (Unclaimed Profile)
Bankruptcy lawyer at Thomas Vogele & Associates, APC
Unfortunately, it appears you are at the mercy of the bankruptcy court's calendar. "Off calendar" can mean many things, from the trustee needs more time to the judge's calendar was too full on that day. As the buyer and non-debtor, you have no legal stake in the motion, although it is very important to you. Speak with the debtor and their lawyer about the motion and see if the delay is going to be a short one. Then try to resurrect your loan approval. The Court must enter an order on the motion to abandon first, then you can complete your purchase.

Does CH7 or CH13 protect me if I am being sued for a past debt?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
Not only does Chapter 7 and Chapter 13 protect you from collections of a "past debt", it ONLY protects you against past debts.  If a bankruptcy case could protect against future debts, then we'd all file a bankruptcy when we were children and then do nothing but incur debt the rest of our lives without having to repay. Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.
