You need to file a motion in the case the garnishment was in for release of the funds being held, claiming that the debt was discharged and your are entitled to a return of the dough.

As long as your current Chapter 13 case has been pending for more than 2 years, you can file a new Chapter 13 case at any time after your current case is completed** and do a repayment plan on debts that you incurred after your current case was filed.  **Your attorney would need to research whether your existing case would need to actually be closed first, or if entry of the discharge is sufficient to allow you to file a new case.
