Should I file for bankruptcy if I am back on a loan?

Answered by attorney Joseph F. Hook (Unclaimed Profile)
Bankruptcy lawyer at Joseph F. Hook Attorney at Law
Whether you should file bankruptcy or not will require a full review of all of the financial circumstances of your case. Unless your parents obtained a security interest in the car the loan to them will likley be treated as a general unsecured debt. Depending on the value of the car, you may well be able to keep the car. You must list all creditors, including your parents on your bankruptcy schedule should you file.

It is best if you can file bankruptcy prior to the hearing date on the 20th. This will stop the proceedings on the 20th. Prior to filing bankruptcy, you will need to take a credit counseling course from an approved agency. Some attorneys will reduce their fee based on the client's income.

Your bankruptcy will remain on your credit report for up to 10 years. You cannot remove it earlier. Try rebuilding your credit by the use of prepaid credit cards or an auto loan.
