Can I get a secured credit card while in bankruptcy?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
It would be up to the creditor to decide whether or not to accept you as a customer. Nothing in bankruptcy law prohibits you from doing this. However, some Chapter 13 Plans prohibit you from taking out any additional debt and this could be an issue of whether or not the secured credit card is in fact a debt.

How can I get the title of a car I bought after filing for bankruptcy?

default-avatar
Answered by attorney Roger J Bus (Unclaimed Profile)
Bankruptcy lawyer at Debt Relief Law Center
That is a toughie- have to beg the secured creditor now to give you a release of lien on the car title. If they refuse, drop the vehicle off at the creditor's parking lot with the keys. Probably too expensive to file a Motion to reopen your very old bankruptcy case and try to have the bankruptcy judge order for you to have a free title.

When one files Bankruptcy, does that relieve them of paying a Court Ordered payment through n Divorce?

default-avatar
Answered by attorney Alan Emmerson Ramos (Unclaimed Profile)
Bankruptcy lawyer at Alan E. Ramos Law Offices
It depends. If the court order is a Domestic Support Order (for support), it is non-dischargeable in bankruptcy. If it is to equalize assets, it would most likely be non-dischargeable in Chapter 7 and will likely be dischargeable in Chapter 13. You should see an attorney to review the court order to determine what effect, if any, bankruptcy will have on it.
