Can I keep state and federal tax refunds under chapter 13?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
Not unless you have found an exemption that covers these assets and your plan doesn't say that you are required to turn them over. However, every chapter 13 plan that I see does require the tax refunds to be paid into the plan to be used towards paying unsecured debts.

How can I file bankruptcy for my brother who is in prison?

default-avatar
Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
You cannot file a bankruptcy for your brother. He has to sign the documents, himself. And he must attend a creditors meeting. You can assist him in hiring an attorney and getting all his financial information in order, including the names and addresses of everyone he owes money to, and a complete list of all of his assets with values. That will be a good start.

Will a discharged chapter 7 bankruptcy protect us from foreclosure?

default-avatar
Answered by attorney Theodore L. Araujo (Unclaimed Profile)
Bankruptcy lawyer at Theodore Lyons Araujo
No. The mortgage secures the Note, which requires payments. The Chapter 7 relieves you from liability for the Note payments, but the bank can still take the house in a foreclosure if you do not make your payments.
