Depends. The Chapter 13 Trustee does not require you to lose your tax refunds if you are paying unsecured creditors 100% through the Plan. If less than 100%, then you would be required to turn over to the Trustee your tax refunds, if any, unless the Plan so other states and/or you show the Trustee why you need the tax refunds each year.
