Please consult with an experienced bankruptcy lawyer. If your car is an older car, you may be able to file a chapter 13 case and pay the lender back the value of the vehicle through the chapter 13 plan. If the reason you no longer want the car is because it is not worth the debt and the payments are not affordable, chapter 13 may be an option for you.

If you sign a loan modification agreement post filing it has the same effect as signing a reaffirmation. After signing you are responsible for any deficiency should you fail to comply with the terms.
