He can file individually. Only currently married spouses can file jointly. Since he is married to you, he cannot file a joint petition with the ex. The question is whether you should file with him. I don't see why you should but that is a vastly different and much more complex question.

By filing for bankruptcy ones debt is discharged. If you're eligible for a chapter 7 this does not require any payment on the debt. If your only recourse is chapter 13 you must make anywhere between 36 to 60 monthly payments in order to receive your discharge. The discharge affects only those individuals to file bankruptcy, not their children.

You can always settle. Call the bank and tell them that you do not want to litigate. You want to pay them a fair amount. Settle the case.
