Can guns be kept in chapter 7 or will they be taken from us?

Answered by attorney Kevin W. Bruning (Unclaimed Profile)
Bankruptcy lawyer at Bruning & Associates, P.C.
Guns are no different than any other asset in a Chapter 7. If the trustee believes she can monetize the asset for the benefit of your creditors, and if you do not assert an exemption to protect the property, the trustee will order you to turn the guns over for sale.

Can someone file Chapter 11 Bankruptcy to save their property from fraud foreclosure?

Answered by attorney Austin M Hirschhorn (Unclaimed Profile)
Bankruptcy lawyer at Austin Hirschhorn, P.C.
It sounds like your friend has conveyed the property from a corporation to herself to avoid a procedural rule. I expect that if someone made the court aware of it or if the court found out what had been done that it could be determined that the filing was made in bad faith and the case could be dismissed by the court.

If my Chapter 7 was discharged, can I still reopen it due to emergency?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
Negative. Even if you could re-open, those bills are post petition, so they would not be part of it.
