Can I file bankruptcy on accounts that I know are scams?

Answered by attorney Edward M Olson (Unclaimed Profile)
Bankruptcy lawyer at Olson Law Firm
Every bankruptcy filing will list all of your assets and all of your debts. It is perfectly legal, however, to enter into "reaffirmation" agreements with only some creditors. In other words, make a new promise to pay their claim. You also have the right to voluntarily pay a debt that was discharged in bankruptcy. Only the creditors are bound by the discharge. They cannot pursue their claim against you. So, yes, if you otherwise qualify for bankruptcy, you can file, and still pay some of your creditors voluntarily.

Will bankruptcy affect his case or should we postpone our wedding?

Chapter 7 bankruptcy doesn't affect changes in the debtor's circumstances which occur after the filing date (except in a few circumstances). Being married will not affect the bankruptcy.

So the court issued 45,000 of these letters in every case filed for 10 years.  I have dozens of clients with this issue.  You do not have to do anything.  I tried to call the court to find out the reason, and was told I was the only lawyer who called, and the Clerk refused to tell me the reason.  I find that hard to believe.  I think this move by the court is outrageous, and I still do not know what the "error" is.  One of the worst cases of bureaucratic B.S. I have ever seen.
