Bankruptcy attorneys in a Chapter 7 case usually show that Schedule I (income) is equal to or lesser than Schedule J (ongoing living expenses). If your Schedule I is far greater than Schedule J, then the Court may believe you have "disposable income" and should be in Chapter 13.

Chapter 13 bankruptcies last from 3-5 years. The issue of each year's tax refund depends on where you are located. Different chapter 13 trustees have different practices on how refunds received during the plan are treated. Sometimes the issue is just whether the refund is larger then the refund in the year prior to filing. This issue should be discussed with your local attorney.

IN NJ, you can file a C13 four years after the C7. Not before. You are saying it differently in your text, that it was a C13 first, which would also require at least four years, unless it is w/o discharge.
