It depends. What was the prior bankruptcy and did you receive a discharge? Assuming you received a discharge, it is 8 years between Chapter 7 cases. It's 4 years between a prior 7 and a desired Chapter 13 (if you want a discharge in the 13). There are other rules that can apply for other scenarios.

I am assuming that what happened 5 years ago was a discharge in a Ch. 7 case. If so, then you can file a Ch. 13 so long as 4 years have passed since the filing date of the prior case in which you got a discharge. You have to wait 8 years if you want to file another Ch. 7.

The short answer is - you cannot be discharged of a 401K loan in a chapter 7. The loan is secured by your 401K. Secured debts are either reaffirmed (paid according to the contract), paid the fair market value of the collateral ( in this the cash) or surrendered. If you wish to cash in your 401K to stop making the payments, you will be assessed applicable early withdrawal penalties.
