When refinancing a mortgage, why does the new lender want the existing mortgage affirmed?

The people that tell you this are ignorant. Reaffirming a mortgage isn't required to refinance. My best guess is that the new lender wants proof of your timely payments on the old loan and you can provide this by ordering an account history from your prior lender. If you are attempting to refinance with your old lender, you need to shop elsewhere. By claiminig you have to reaffirm to refinance, they are saying they don't want your business.

Get a copy of your discharge, you should be able to do this. If the title company will not close, get another title company, there are plenty. Your bankruptcy may not actually be closed. But that should not matter, and you do not need court approval.
