Chapter 7 is means tested for income. If your income after certain expense are deducted is over the threshold you will not be able to file a Chapter 7. You will have to file a chapter 13 or pay the debts. It sounds as if you may qualify for a Chapter 7.

You are going to lose the house, that's what happens if you don't pay the mortgage. You have no personal liability on the mortgage. If you're leaving anyway, I'd recommend that you hire an attorney to negotiate a deed in lieu or a short sale.

You can sue her in NY.  Also, you should file an ethics grievance with the bar.  A sanction in New York can be reported in Texas too, and might be your biggest stick.
