How will my boyfriends bankruptcy affect me?

Answered by attorney Michael Jay Berger
Bankruptcy lawyer at Law Offices of Michael Jay Berger
Your credit will not be affected by your boyfriend's bankruptcy filing. His bankruptcy will appear on his credit report, not yours, as bankruptcies are tracked by the social security number of the individual that filed the bankruptcy. However, your boyfriend's bankruptcy may affect the house that you have in both of your names. This home could be lost in foreclosure if payments are not made per the Chapter 13 plan confirmed by the Court (if a plan is confirmed), or per agreement with the lender, if there is no confirmed plan, or if the lender seeks and gets relief from stay.

Can a dealership have you sign a paper stating if you file bankruptcy, you won't be able to put said vehicle under that bankruptcy?

They can also ask you to give up your first born but such agreements are not likely to be held up in court. I'm not sure what your real concern here is, I assume you are not considering purchasing a car on credit and then filing bankruptcy and returning the vehicle.

How many Chapter 13 filings can you do in one year to sell the home?

Answered by attorney Sanaz Sarah Bereliani (Unclaimed Profile)
Bankruptcy lawyer at Bereliani Law Firm, PC
The first chapter 13 in a year has full bankruptcy protection. They cannot take any action against you. The second bankruptcy case has 1 month of bankruptcy protection. A Motion to Extend the Autostay Protection needs to be filed to extend it for the full term of the bankruptcy. The third case has virtually no bankruptcy protection. You'd have to file a Motion to Reinstate the Bankruptcy protection and have a very good reason why you are filing 3 cases in one year. It is not guaranteed that the Judge will extend the autostay, stating that you are taking advantage of the court system.
