Would it benefit us if we told the trustee via letter about the debtor's assets?

Answered by attorney Alan Emmerson Ramos (Unclaimed Profile)
Bankruptcy lawyer at Alan E. Ramos Law Offices
If the debtor did not list the assets and the trustee never finds out about them, the debtor will receive his discharge (with the debt to you being discharged) and the debtor will still have the assets. I would recommend that you notify the trustee about the assets. This will allow the trustee to investigate the assets and determine if they have value to the estate. If they do have value, the trustee can sell the assets and return some money to creditors.

Can a bankruptcy trustee override a marital settlement agreement?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
The trustee is probably open to negotiation and may indeed settle on something like $1000. The settlement agreement should be viewed in full. You waived alimony in return for a larger portion of the home. Have your divorce attorney contact the trustee to negotiate.

Can the creditors still contact me during bankruptcy?

Robert Louis Peters
Answered by attorney Robert Louis Peters (Unclaimed Profile)
Bankruptcy lawyer at Robert L. Peters, Attorney
When you file bankruptcy you are immediately under a protection from creditor collections. You should provide any creditors who contact you with your bankruptcy case number and in addition refer them to contact your attorney. I would also recommend keeping a log of the phone numbers, name of the companies, times of the calls as well as any other correspondence you receive. Provide this information to your attorney as the creditor may be in violation of the Federal Bankruptcy Laws and possibly FDCPA laws. Your attorney can file for a motion for sanctions with the court if he deems it's needed.
