When you file bankruptcy what happens if I owe money on my home, do I lose my home and how do I go about filing for bankruptcy?

Answered by attorney Philip Rory Boardman (Unclaimed Profile)
Bankruptcy lawyer at Haven Law Group, P.C.
You could lose your home to the Trustee if there is equity that can not be protected. Normally, as long as you can still pay your monthly mortgage, you can keep your house. Your first step in filing should be to make an appointment with a bankruptcy attorney.

Do I have to sell my home if I filed a chapter 7 bankruptcy?

Answered by attorney Roger J. Bus (Unclaimed Profile)
Bankruptcy lawyer at Debt Relief Law Center
In Chapter 7, if you want to keep your house, be sure to keep your house payments up to date. Most mortgage companies will not foreclosure if you are current, even if you did not reaffirm on the mortgage debt.

My boyfriend is responsible for our daughter's daycare expenses but since he filed for bankruptcy can they legally sue me?

Answered by attorney Roberta Ohlinger-Johnson (Unclaimed Profile)
Bankruptcy lawyer at Harris, Yug & Ohlinger
In Nevada, assuming it is his name on the contract (not yours), since you were never married, the answer is no. But they do not have to provide services either if they aren't paid. On the other hand, if you signed the contract also, then yes.
