Payday loans can be discharged. Student loans cannot be discharged unless they would be an undue hardship on the debtor.

Is the insurance company still requried to pay me the rest of my settlement? Do I need to get a lawyer?

Answered by attorney Mark J Markus

There's nowhere near enough information to answer your question.  Which bankruptcy chapter did the insurance company file?  Are assets being liquidated to pay claims?  Have you filed a claim?  How much are you owed? You need to consult with a bankruptcy attorney in the location where the bankruptcy case was filed for more information.  Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.

Can I file bankruptcy on the IRS if I go ahead and file?

If the taxes have not been assessed for three years, they can be discharged. However, if you have not filed returns, the three year period does not start. You have le a return before the IRS can assess any taxes.
