How will filing bankruptcy affect my case as a plaintiff in a personal injury case?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
Consult your bankruptcy lawyerand if you have filed without one, hire one now. It's almost always worth the investment. Secondly, you can exempt a certain amount of the proceeds from such a lawsuit in a bankruptcy. Have your lawyer check 11 US.C. sec. 522(d), and the equivalent state law on exemptions. In some states, including Wisconsin, you can choose either the state or the federal list. The federal law of bankruptcy permits states to require their residents to choose only the state list of exemptions, and about 35 states have done so.

What is the difference between eliminating debt and discharging debt for bankruptcy? How?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
The distinction will depend on the type of debt that is discharged. If you discharge a credit card, you no longer have the legal obligation to pay on it and the credit card is cancelled. If you discharge a car loan, you no longer HAVE to pay it, but it you DON?T pay it, the lender will repossess the car. So the car loan has been discharged, because you don?t have to pay it, but the car loan isn?t eliminated because you didn?t just get a free car.

Will the bank take back car if you have a car loan and you filed bankruptcy?

Answered by attorney Yahima Suarez (Unclaimed Profile)
Bankruptcy lawyer at Hernandez & Suarez, PL
You have two options if you are paying for a car and you are filing bankruptcy. One, you can keep paying for the car and assume the debt. Many times, you are able to negotiate a better interest rate. Two, you may just let the lender keep the car and the debt will be discharged in bankruptcy. To make sure, I am specifically addressing the filing of a chapter 7 bankruptcy.
