Does a judgment creditor's attorney have the legal right to demand a re-evaluation of my financial situation?

Answered by attorney Daniel A. Edelman
Bankruptcy lawyer at Edelman, Combs, Latturner & Goodwin, LLC
This depends entirely on what was agreed to. Generally, it is not a good idea to enter into an agreement that does not fix the total amount to be paid and the precise schedule, although I have seen these.

Answered by attorney Mark J Markus

You need to have a consultation with a bankruptcy attorney in your area.  There are insufficient facts to answer your questions. Whether you can keep assets depends on the value of the assets, the exemptions available to protect them under applicable law and other factors.   Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.

Whatever the contract provides. Most likely the co-signer is responsible for the debt and can be sued if the contract and law provides.
