Because you discharged your obligation to pay the mortgage in the bankruptcy, unless the family court ordered you to pay this debt as part of the divorce settlement, you are done. All the mortgage company can do is conduct a foreclosure sale. But your ex spouse may still have the right to pursue you under the terms of the divorce decree in spite of your bankruptcy. Yes, very much so. If he defaults on the house note, and you are the co-signer, your recourse is to file your own bankruptcy and/or consult a divorce attorney if the terms of the divorce decree were violated by him.

I recommend retaining counsel to help you defend the suit. Otherwise, I recommend trying to defend yourself. If you do nothing the trustee will get a judgment against you and be entitled to collect it from you. Are you the debtor or the recipient of funds from the debtor? If you are not the debtor you may have defenses.
