1. You cannot be prosecuted for failure to repay a loan 2. A secured party (title loan company) is required to dispose of collateral (car) in a commercially reasonable manner with proper notice of the proposed sale, and an accounting for the proceeds of the sale. If they fail to comply there are substantial statutory damages, and they may not be able to recover any deficiency. Refusing to take the car from the parking lot where you put it at the direction of their agent is not commercially reasonable. Do not assume you owe anything at this point in time. 3. A debt collector that pretends to be a government agent or which falsely represents that suit has been filed when that is not the case violates the Fair Debt Collection Practices Act. You have only one year in which to sue.
